General Duties and Responsibilities:
The Associate General Counsel – Field Operations and Employment Law is responsible for providing practical, timely, and high-quality legal services. The Fullerton AGC will be responsible for the Portland and Southern California Divisions, which have stores located in California, Oregon, and Washington. The Malvern or West Bridgewater AGC will be responsible for the Northeast (Shaw’s) and Mid-Atlantic Divisions, which have stores located in Maine, New Hampshire, Vermont, Massachusetts, Rhode Island, Connecticut, New York, New Jersey, Pennsylvania, Delaware, Maryland, and Virginia.
The successful candidates serve as primary legal advisors to the Division Presidents and other Division staff. The Associate General Counsel’s primary responsibility is to facilitate the business objectives of the Company by providing timely and effective legal support to the respective Region, and to minimize potential legal exposure and risk.
With the oversight of Senior Vice President- Field Ops, provide legal support and advice to Division leadership and staff on matters including HR/personnel matters, customer disputes, regulatory oversight and compliance, investigations, and litigation/dispute resolution.
Provide advice and counsel to Human Resources, Associate Relations and Operations on all aspects of employment law.
Direct investigations by Asset Protection and/or Human Resources.
Analyze complex commercial/business concepts and identify relevant legal issues and related, real-world risks; provides prompt, clear and practical legal analysis, advice, and solutions; and generally, assist the business in achieving its goals.
Utilize high-level communication skills, both oral and written, to effectively communicate with various levels of staff and management, and in various settings.
Advise, counsel, and actively participate in the development of regional and corporate procedures, practices, and systems that support business objectives, mitigate risks, and facilitate a culture of compliance.
Exercise sound legal judgment and act as a key partner for internal business stakeholders; act independently and prioritize tasks while considering relevant risk, business and objectives.
Develop and deliver training on legal issues.
Support the Company’s diversity objectives.
Manage outside counsel handling employment-related lawsuits, including class actions.
Respond to attorney demand letters and negotiate early resolution of employment disputes.
Represent the Company in matters before federal, state and local administrative agencies.
Facilitate communication between Divisions and Legal Department SME’s.
Travel will be required to support local and out-of-state clients.
Desired Skills and Experience:
JD from an accredited law school with proven academic success.
Licensed to practice law and in good standing with the Bar of any state that enables admission to practice as in-house counsel.
12+ years of legal experience, including in-house practice.
Extensive commercial experience.
Understanding of employment law; Fullerton AGC must have broad knowledge of California Employment laws.
Ability to identify and analyze complex issues and evaluate their broader implications for the business; interact with clients at all levels; think strategically; provide timely, practical, legal advice and solutions; and communicate effectively in person and in writing.
Ability to work independently, exercise good judgment, and take ownership of issues and matters to their successful conclusion.
Excellent interpersonal skills, with an ability to inspire trust and confidence with stakeholders at high levels, and to build strong relationships across the organization.
Exemplary leadership, time management, advocacy and organization skills.
